INFORMATION AND REQUIREMENT FOR RECORDATION

All trademarks relating to goods to be imported into Mainland Tanzania will now be required to be recorded with the Chief Inspector of Merchandise Marks, regardless of their place of initial registration. This new measure will accord all recorded trademarks proactive protection against counterfeit imports, in line with the provisions of the Merchandise Marks Act.


Requirements for Recordation

A. Ownership and Originality

  • Applicant particulars: Full name, business address, and telephone number.
  • Trademark owner's nationality: In the case of a company, its country of incorporation and in or in case of a partnership, the nationality of each partner
  • Place of manufacture of goods bearing the trademark to be recorded
  • Sample of the trademarked goods or a sufficient digital photographic representation of the trademarked goods with appropriate details for identification and differentiation from any counterfeits
  • Names and business addresses of any foreign person or entities licensed to use the trademark, and the nature of such authorized use (if any)
  • Particulars of any parent, subsidiary, or affiliated companies under common ownership or control that use the trademark abroad (if any)
  • B. Trademark information

    1. Description of the trademark - Trademark registration number and the date of registration. Country where the trademark is registered.
    2. A certified copy of the trademark registration certificate.
    3. Description of goods: The type of goods to which the trademark relates.
    4. Statutory Declaration - this must be affirming that the applicant is the legitimate owner or an authorized agent of the trademark and that the information provided is accurate and truthful.

    C. Agent

    Details of the agent: Power of attorneys showing the full name, business address, and telephone number of the agent.

    D. Payment

    proof of payment of application fees- if the trademark is registered for more than one class of goods, the fees for recordation shall be for each class.


    Time frame - 21 days from the date of application.

    Validity and Renewal of Recordation - The recordation shall remain valid for one year from the date of approval. An application for renewal must be made not later than thirty days before the expiry of recordation

    Assignment or transmission of recorded trademark - the new owner is required to notify the Chief inspector if he intends to maintain the recordation within thirty days after assignment or transmission. Failure to make notify within the prescribed time the recorded trademark shall be deemed to be cancelled

    Change in name of owner of recorded trademark - the registrant must notify the Chief Inspector within seven days in writing by submitting a certified copy of the change of name and any other relevant information
