Before delving into the role of substantive examination, it is important to understand the close relationship between quality and value. For any product or innovation to hold a strong market position, it must possess quality, which in turn drives its market value.

In the context of patents, once a patent is granted for a product or process, the patent owner obtains exclusive rights to manufacture, use, import, offer for sale, or utilize that product or process.

Substantive examination refers to a comprehensive review of a patent application’s technical and legal merits, including an assessment of novelty, inventive step (non-obviousness), and industrial applicability, beyond the initial verification of formal requirements.

It is widely recognized that substantive examination demands significant financial resources and specialized expertise. Unfortunately, many African countries face challenges in this regard due to limited funds and skilled personnel. For example, Tanzania primarily focuses on formalities checks rather than conducting substantive examinations. However, there is a positive development: substantive examination can be conducted through regional intellectual property organizations such as the African Regional Intellectual Property Organization (ARIPO) and the Organisation Africaine de la Propriété Intellectuelle (OAPI).

ARIPO operates under the Harare Protocol on Patents and Industrial Designs and currently has 20 member states, including Botswana, Ghana, Kenya, Tanzania, Uganda, and Zimbabwe, among others. OAPI, on the other hand, is a union of 17 former French colonies, including Benin, Cameroon, Ivory Coast, Mali, and Senegal, where a patent granted by OAPI is enforceable in all member states.

To improve efficiency while upholding stringent patentability standards, ARIPO has also introduced accelerated substantive examination procedures.
